I also just learned Peltier is using a walker now, he's blind in one eye from a partial stroke (not sure when that happened) and is struggling with an aortic aneurysm. "Someone at the prison described him as a model prisoner who has no business being there," said his attorney.

Jennifer Bendery
22 hours ago:   Monday Dec 5 - 5:04pm
Peltier's attorney says he's in a lot of pain because his diabetes isn't being managed well, which causes pain from sciatica, which requires space to manage. The space in Peltier's confinement cell is 18 inches for him and 18 inches for his cellmate.

Jennifer Bendery
22 hours ago:   Monday Dec 5 - 5:01pm
Apparently lockdown at Peltier's prison in Florida = Peltier confined 24/7 to a 7x12 room with a cellmate, two beds, two sets of lockers, a toilet and a sink. Peltier, who is 78, is "really depressed" and his diabetes is in a bad state, in part because of the confinement.

Jennifer Bendery

Speaking of Peltier, I just heard from his attorney (aka a former federal judge appointed by Obama) who said Peltier is struggling health-wise as his prison has been on lockdown for at least 2 weeks. He's been confined to a cell with another person with 36 inches between them.

... tribes can't do shit when a non-Native person, on THEIR land, commits crimes. A full Oliphant fix is like saying yes, the federal government recognizes that tribes are sovereign nations and should have full jurisdiction over people who commit crimes on their land.

Jennifer Bendery
1 day ago:   Monday Dec 5 - 2:44pm
This year, Congress expanded VAWA to give tribes the ability to participate in having "special tribal criminal jurisdiction" to arrest + prosecute non-Native people on tribal land in specific cases involving violence (with kids, dating partners, cops). So that was good. But....

Jennifer Bendery
1 day ago:   Monday Dec 5 - 2:35pm
A "full Oliphant fix" would gives tribes full criminal jurisdiction over non-Native ppl who commit crimes on tribal land. Tribes currently only have limited jurisdiction over non-Native men who are violent toward Indigenous women, which hampers tribes’ ability to punish them.

Jennifer Bendery
1 day ago:   Monday Dec 5 - 2:34pm
You could prob carve out and introduce 20 individual bills out of this one bill. Or more. One thing, for ex, that could be carved out -- and is a major public safety issue for tribal leaders -- is the provision calling for a so-called “full Oliphant fix."

Is this bill going to pass anytime soon? No. Will it ever? Probably not. But that's not really the point, Warren would argue. It's more of a starting point for lawmakers to fully grasp the problem, and then have legislative solutions ready to act on. https://t.co/agpL7JRGcO

Jennifer Bendery

Warren's bill lays out specifically how and where the government should be directing mandatory, full federal spending to tribes to make up for decades (centuries?) of chronic underfunding, in 5 areas: housing, education, health care, economic development and public safety.

Jennifer Bendery
1 day ago:   Monday Dec 5 - 2:06pm
This bill has been in the works for years, and written with extensive input from tribal leaders and citizens. It’s in direct response to a damning 2018 report by the U.S. Commission on Civil Rights that detailed just how badly the fed government has been underfunding tribes.
